These general terms of use (the “Terms”) apply between you as a customer (“Customer”, “you”) and Finess Borrby AB (called IDUN referring to the trademark) that is 100% controlled DUNI AB company, Reg. No. 556262-2604, address c/o DUNI AB

BOX 237, 201 22 Malmö (“IDUN”, “our”, “we”), when you use IDUN’s mobile application (the “Platform”).

 

IDUN offers consumer services for reusable and single use packaging related to food, beverages and other goods servings (the “Service”) in restaurants, hotels, catering companies and stores connected to IDUN’s Platform (“IDUN Partners”). By registering an IDUN user account or by using the Service you confirm that you have read and agree to the Terms.

 

The Terms constitute the entire agreement between the parties of all matters to which the Terms relate. If you have any questions regarding the Terms, you may always contact our customer service.

 

What does IDUN do?
IDUN offers a reusable and single use circular system for foodservice packaging distributed by IDUN Partners to increase reuse and recycling of their packaging.

 

IDUN offers three types of services

  • IDUN clean – then you use the system in an closed area and / or on premises of an IDUN partner.
  • IDUN go – then you use the system in an open area and / off premises of an IDUN partner (‘to go’).
  • IDUN untrash – then you bring back a single use package and receive a reward, discount or other consumer incentive offered by IDUN.

 

What do you commit to?

  • You are responsible for ensuring that the information you provide when registering your user account with IDUN is correct. You also warrant that all content and information that you provide or make available to us by your use of the Services is accurate.
  • You agree to keep your login credentials and other account information confidential and secure and to not share such information with anyone else.
  • You agree to not use the Platform or Service in any improper manner and to not behave in any fraudulent or unauthorised way. IDUN reserves the right to suspend any user that is not in compliance with this and that such user may be charged for costs and damages suffered by IDUN or any of the IDUN Partners.
  • You verify that you are eligible to accept these Terms with binding effect. If you add a payment card to the Platform, you also verify that you have the lawful right to use that payment card.
  • You may not use any IDUN trademarks or brands beyond what is required to use the Platform or the Service.

 

Handling your personal data responsibly and keeping it safe
We process your personal data in accordance with IDUN’s privacy policy. By using the Platform you acknowledge that IDUN may need to send emails and/or notifications to be able to fulfil our obligations in relation to your Orders.

 

Complaints and feedback
We hope that you will be happy with the Service, but misunderstandings do happen regardless of how hard we try to avoid them. If you have any feedback or are unhappy with the Service, please contact us immediately by using the contact information on IDUN website idun.co. We will get back to you as soon as we can. We always follow the applicable consumer protection legislation. IDUN reserves the right to determine what is considered an appropriate solution case by case.
If you wish to receive a refund for a Product purchased in-store, please contact the restaurant or store where it was purchased. If you wish to receive a refund for an Order made in the Platform reach out to us via the contact information on IDUN’s website.

I have failed to follow these Terms, what can happen?
Now first of all, let’s hope this doesn’t happen. We are all on the same mission to save the planet. However, IDUN reserves the right to terminate the Service or to suspend the use of the Platform for customers that violate these Terms. Termination takes place immediately and you will be notified by e-mail.

 

Miscellaneous

  • These Terms may be updated from time to time. We will publish the new terms on our website. The changes will apply as from the date on which they are published on the website. In the event we make any material changes to the Terms we will notify you via e-mail or other notification methods. By using the Service after we have sent such a message you accept the changes.
  • You may not use the Platform or the Service for commercial use.
  • IDUN reserves the right to use all input from you, such as feedback or other data, for the development and improvement of the Platform and Service.
  • IDUN may transfer its rights and obligations under the Terms to a third party, provided that the acquiring third party can be expected to fulfil its obligations under the Terms in a satisfactory manner.
  • In addition to what is stated in the Terms, and unless otherwise follows from mandatory law, the following applies referring to IDUN’s liability to you:
    • Except for what is explicitly stated in the Terms, IDUN does not make any warranties on the Product or packaging provided by IDUN Partners. Furthermore, IDUN does not make any warranties regarding the function, availability, usability or security of the Platform or the Service.
    • IDUN is not responsible for unauthorized access to, or any modification of, information that you submit to IDUN. Neither is IDUN responsible for any material or information that you receive. Additionally, IDUN is not responsible for criminal acts committed using the Service, such as threats, slander, any obscenity or disruptive, abusive, inappropriate, or illegal content or behaviour by any user.
    • Unless caused intentionally or by gross negligence, IDUN is not responsible for any direct or indirect damage caused by your use of the Platform, the Service or by information from IDUN.
    • IDUN reserves the right to suspend or cancel its services and/or the preparation or delivery of a Product if the Customer has entered insufficient or incorrect information when registering the account used or if the IDUN Partner is unable to complete the order for some reason.

 

Dispute resolution
Any dispute, controversy or claim arising out of or in connection to the Terms will be interpreted in accordance with Swedish law.

In case of a dispute between IDUN and you, the parties will, as a first step, try to resolve the dispute by agreement. If this is not possible, the dispute will be determined by the National Board for Consumer Disputes (Swe: Allmänna reklamationsnämnden) or, ultimately, by a general court.
